FEED AND GO™ Privacy Policy


This Privacy Policy covers how Feed And Go, Inc. (“Company”, “we” “our” or “us”) will collect, use, manage and store your personally identifiable information (“Personal Data”), financial information (“Financial Data”) as well as general demographic and behavioral information we gather (“Demographic Data”)  when you access or use our Feed And Go™ Platform, including when users post their User Generated Content to the Site (the Personal Data, and Demographic Data are collectively referred to as the “Data”). Capitalized terms contained herein shall have the same meanings ascribed to them in the Site’s Terms of Use.

We know that you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy policy.

By accessing the Feed and Go™ Platform and/or voluntarily providing us with your Personal Data, you are consenting to our use of your Data in accordance with this Privacy Policy.

We comply with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland.  We have certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.  To learn more about the Safe Harbor program, and to view our certification, please visit http://www.export.gov/safeharbor/

1. Demographic Data

Through the use of certain technologies we are able to track and store certain types of information whenever you interact with our Site and/or the Feed and Go™ App. We only use Demographic Data in aggregate form, for statistical purposes, and not in a manner that would give us sufficient information to identify you personally. This type of aggregated Demographic  Data enables us to figure out how often Users access parts of the Site and/or Feed and Go™ App, what types of Content or features they are most interested in, where they are generally located and what are their general online / mobile behavioral patterns. We utilize this information so that we can improve the Site, the Feed And Go™ App  and the Content.

This Demographic Data may also be shared with advertisers and other third parties on an aggregated basis, but it does not include the Personal Data or Financial Data of Users. Also, we may share Demographic Data  and non-identifiable (e.g. hashed) Personal Data to third party advertisers and data brokers so that they can determine User preferences based upon online behavioral patterns and can serve contextual advertising while users are visiting the Site and/or the Feed And Go™ App to enhance the User experience with more relevant advertisements. Users may opt out of these services as prescribed in Section 6 below.

(a) The Site. With respect to the Site, we automatically receive and record information on our server logs from your browser including IP addresses, cookie information, browsing history and the Site pages requested. Our use of cookies, pixel tags and IP Addresses are set forth accordingly:

(i) Cookies are small bits of information that that a website can send to your browser and may then be stored on your computer’s hard drive. It acts as an anonymous tag that identifies your computer, but not you personally. Cookies have the ability to store information about web pages viewed and the advertisements viewed or clicked. For registered users, cookies can also save user information and screen preferences. The Company uses cookies for improving the Site usability and aggregating non-identifiable behavioral information for both internal purposes and for sharing with our advertisers. Our cookies do not collect or contain Personal Data, but may reflect de-identified demographic or other data linked to the registration data you have submitted to us, e.g. your email address, in hashed, non-human readable form. To opt-out of these cookies, please go to http://www.networkadvertising.org/choices/. While you may also turn off your computer’s acceptance of cookies through your browser, your full use of the Site and Services may be restricted.

(ii) Pixel Tags, also known as a clear GIF or web beacon, is an invisible tag placed on certain pages of the Site but not on your computer. When you access these pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. We use pixel tags for Site analytics, site crawling across our Feed And Go™ Platform and to serve you more relevant Content and ads based upon your historical behavioral patterns. If you turn off cookies the pixel tag will simply detect an anonymous Site visit.

(iii)  We collect your computer’s IP addresses in order to conduct system administration, to conduct Site analysis, block computers who have violated our Terms of Use, and identify computers which may be engaged in illegal or illicit activity on our Site. While we do not associate IP addresses with records containing Personal Data, we will use IP addresses to identify any user who refuses to comply with these Terms of Use or otherwise violates any applicable laws. Additionally, we may be required to disclose IP addresses pursuant to a court order or subpoena.

(b) The Feed And Go™ App. With respect to the Feed and Go™ App, it may transmit certain geographic information or other general non-identifiable information regarding your mobile device to us. We may use that information to generate aggregate statistics about our User community and may provide that information to advertisers and other parties with whom we have a business relationship. In addition, we may use any such information for security, system integrity (the prevention of hacking, cheating and other improper or unlawful activities), or enforcement purposes.

When you use the Feed And Go™ App, we will automatically collect and store the following types of non-personally identifiable information received from you: (i) geo-position and location (to the extent not tied to your personally identifiable information); (ii)  behavioral usage (iii) your country;  (iv) the date and time you access the Feed And Go™ App and the duration of your usage;  (v) usage history; (vi) mobile page views; and (vii) the type of handset device and mobile operating system (including version) you are using (e.g. Android, iPhone, etc…). We only use this data in aggregate form, for statistical purposes, and not in a manner that would give us sufficient information to identify you personally. Automatically collected information of that kind typically provides us with a greater understanding regarding the use of the Feed And Go™ App, including which features are the most popular with Users, what types of Content Users are most interested in, where they are generally located and what are their general Feed And Go™ App usage behavioral patterns. That information also allows us to determine if the Feed And Go™  App is working properly, make changes to the Feed And Go™  App that allows Users to have better experiences, and improve our offers and promotional Content so that they are more relevant to our Users. We collect that information and track it for statistical purposes; we may also use it to identify particular offers and promotions that may be relevant to you based upon your geo-positioned location (e.g. sales or coupons on pet food at a nearby retailer). This information may also be shared with advertisers, fulfillment partners and other third parties on an aggregated basis, but it does not include the Personal Data or Financial Data of individual Users.

2. Personal Data

When you use our “Pet Food Calculator” feature or set up a Customer Account when making a purchase, you will automatically be consenting to all of your Personal Data   being collected, managed, used and shared according to this Privacy Policy. You may, under certain circumstances,  opt out of sharing some or all of your Personal Data as further described in this Privacy Policy.

If you provide Personal Data through this Site, you acknowledge and agree that such Personal Data may be transmitted over the Internet from your current location to our servers and re-transmitted to the servers of our authorized third parties located throughout the United States. .

(a) Information Collected Through the Site: We collect Personal Data through the Site when you voluntarily chose to provide us with such Personal Data, such as through one or more of the following options:

(i) Device Purchase; Subscription. When you purchase a Device through our Site, you will be required to set up a User Account which will contain your Personal Data. The following Personal Data will be required in order to set up your Customer Account and use the Services: Your name, e-mail address, mobile phone number, Device serial number (which shall be assigned when your Device is shipped), transaction history, shipping information, information pertaining to your pet (including, without limitation, breed, age of pet, type of food, pet insurance information, feeding schedule, amount of food per feeding, etc…), and other information such as gender.

(ii) Social Media. You may also authorize us to obtain certain Personal Data through third party social media platformsin order to receive communications from us regarding offers, promotions, features and information related to the Feed and Go™ Platform. Such social media site’s privacy policy shall apply with respect to your Personal Data contained on that site and you may opt out of receiving communications from us at any time pursuant to such site’s privacy policy.

(iii) Pet Food Calculator. When you use our proprietary pet food calculator, you will be required to provide your email address as a way for us to communicate with you regarding offers, promotions, features and information related to the Feed and Go™ Platform. You may opt out of receiving communications from us pursuant to Section 6 below.

(iv) Comment Thread Discussions. Users may comment on the Feed And Go™ Platform  on the Site. While we do not actively mine for a Users’ Personal Data disseminated through such means, we will be storing this User Generated Content and therefore may collect such information indirectly. Although we do not monitor the exchange of Personal Data that Users disclose to other Users in the commenting feature of our Site, such data may be mined by third parties including other Users and our advertisers as such data is considered publically accessible. Further, while we do not give advertisers direct access to Personal Data except as otherwise may be provided under Section 6 of this Privacy Policy, our advertisers may be able to derive a User’s identity from such public postings and link it to their Personal Data acquired from other sources.


(b)  Information Collected Through the Feed And Go™ App. While we do not collect any Personal Data from you when you download the Feed And Go App™ (and such information is only collected by the Apple and Google  pursuant to their respective privacy policies), when you sign into you Customer Account through the downloaded Feed And Go™ App through your mobile device in order to use the Services, we are able to link your information specified in Section 1 (b) above to your Personal Data.

(c) Method of Contacting Users. We may use Personal Data collected from you to contact you regarding any purchase made by you, your Customer Account, the Services, your Subscription (if applicable), your Device, the Feed And Go™ Platform and/or products and services we think may be of interest to you. We may also share your Personal Data with our advertisers who may contact you with respect to products and/or services they think may be of interest to you. Typically, you would be contacted by us(or any other party authorized under Section 6 below) through email, notice on your Customer Account, SMS (Data and Message Charges From Your Carrier May Apply) or pop-up windows on their browser and/or mobile phone when you access the Site or the Feed And Go™ App. You may only opt out of certain categories of contact and methods of contact as set forth in Section 6 and 7 of this Privacy Policy.

(d) Modifying Personal Data/ Sharing Preferences. You may modify or update your Personal Data at any time by logging into your Customer Account and editing your Personal Data. You may also modify your Personal Data sharing preferences under Section 6 below.

(e) Use of Personal Data. We use your Personal Data in a manner that is consistent with this Privacy Policy. Specifically,  we  will use Personal Data to the extent necessary to fulfill your purchase of the Device and Services through the Site, provide you with the products and services offered on this Site and/or through the Feed And Go™ App, to maintain your Customer Account (including authentication), to administer the Feed And Go™ Platform, to facilitate your online transactions on the Site, including e-commerce transactions, to monitor violations of the Terms of Use  (and take appropriate actions as prescribed in the Terms of Use) and as may be otherwise permissible under applicable law.  We may also use your Personal Data to offer you certain products and services we think you may find of interest and share such information with third parties as prescribed in Section 6 below. You may, however, opt out of receiving future solicitations by following the instructions in such email or by communicating your opt out preferences in your Customer Account profile as explained in Section 6 below.

If the Company intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected and will be given an opportunity to opt out of such use. In a case where such proposed usage is necessary to provide enhanced services on the Site, your opting out to such usage may restrict your use of all or a portion of the Site.

3. Financial Data

Financial Data includes, without limitation, your credit card account information, security code, expiration date of your card and billing information such as name, address (including zip code) and email address.  We do not collect Financial Data from you when you use our Site or purchase the Device and Services from us. When you check out with our shopping cart, you will be leaving our Site temporarily in order to provide your Financial Data to our third party shopping cart provider and merchant payment processing partner (collectively the “Third Party Suppliers”). Our Third Party Suppliers collect your Financial Data to process your payments for all of your online financial transactions with us, including, without limitation, your purchase of the Device, our Services as well as any other authorized charges provided for in the Terms of Use. Each of Third Party Suppliers certify that they are PCI Compliant regarding collecting and storing credit card data and customer information. Our Third Party Suppliers do not share your Financial Data with us and we have no access to your Financial Data. You will be redirected back to our Site once your payment is processed.

4. Storage and Data Retention

We store Demographic Data indefinitely. We also store Personal Data so long as you are using the Services and for a period of six (6) months thereafter. Notwithstanding the foregoing, we will retain the information on the Serial number of your Device should you wish to reinstate the Services after the six (6) month period, we may, in our sole discretion, delete or archive Personal Data of suspended or terminated Customer Accounts within a shorter period.

5. Security

We employ reasonable security measures in place to protect against the theft, misuse and alteration of the Personal Data under our control. All Personal Data is housed in a secured internal infrastructure. We utilize the current standard industry practices to maintain security of Personal Data.  However, no Internet, mobile or e-mail transmission is ever fully secure or error free. In particular, online or mobile data sent between this Site, your mobile device and our servers may not be 100% secure and may be subject to vulnerabilities beyond our control. Therefore, you should therefore take special care in deciding what information you send us through an Internet connection or mobile network.

Personal Data contained in a Customer Account may only be accessible through a valid username and password. You are responsible to maintain your user name and password and to not share these with anyone else. We are not responsible for any breaches of your Customer Account and access to your Personal Data which is attributed to lost or stolen user names and passwords. In the event of an inadvertent disclosure of your user name and/or password, your are advised to change your password as soon as you become aware of such disclosure.

6. Personal Data Sharing

We consider your Personal Data to be a vital part of their relationship. In most cases, we will not share your Personal Data without your prior informed consent, and you may opt out of our sharing of certain Personal Data to certain third parties as described in this Section 6. There are however, certain circumstances in which we may share your Personal Data with certain third parties without further notice or your required consent.

(a) Personal Data Sharing That Does Not Require User Consent Or Notice.

(i) Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

(ii) Agents, Consultants and Related Third Parties: We retain the services of third party vendors to perform certain business-related functions for us and to provide you access and use of the Site and all of its Services. Examples include mailing information, maintaining databases and software, customer support, order fulfillment and processing payments. When we employ third parties to perform such functions, we only provide them with the Personal Data that they need to perform their specific function.

(iii) Legal Requirements: We may also disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (1) comply with a legal obligation, (2) protect and defend our rights or property or to enforce its Terms of Use, (3) act in urgent circumstances to protect the personal safety of Users of the Feed And Go™ Platform or the public, or (4) protect against legal liability.

(b) Data Sharing Requiring Consent and Notice.

Currently, we do not share Personal Data other than as set forth above. Should we desire to modify the manner in which they collect, use or share your Personal Data with third parties in the future, we will notify you prior to such change when you log in and any Personal Data collected after the effective date of such change will be subject to the new privacy terms. At the time of the change, you will have an opportunity to opt out of such sharing, if appropriate.

7. Choice/ Opt Out

(a)       Demographic Data. The Company uses third-party advertising companies to serve ads and collect information when users use or access the Feed And Go™ Platform. These companies may use information (not including your Personal Data) about your visits to this and other websites in order to provide advertisements on the Site, the Feed And Go™ App, other websites and other forms of media about goods and services that may be of interest to you. Each of these third party companies may use cookie, pixel tag technology and other technologies to track user behavioral patterns once you access the Site and/or Feed And Go™ App. Some companies may also (1) match a your information in hashed (non-readable and non-identifiable)) format  with third party   opt-in lists ); and/or (2)  transmit advertiser communications that may be relevant to you based upon your behavior, geo-location and/or indicated preferences

In some instances, you may request more information from these third parties concerning their respective products and/or services by clicking on such advertisement. Some of the third party advertisers offer to contact you directly as a way to follow up on your interest in its products and/or services. In such cases, you will be asked for your Personal Data by such third party, and by providing your Personal Data in such a fashion, you are consenting to being contacted by such third party.

(b)       Personal Data. The Site gives users the opportunity to opt-out to receive communications from us and its third party advertisers in your Customer Account profile settings.  Additionally, you will find an opt-out option at the bottom of all communications, or you may write or email us at the below address to opt out of future communications not directly related to your access or use of the Feed And Go™ Platform:

We may provide links to  third party web sites which are provided solely for your  convenience. However, even if a third-party affiliation exists between the Site and that destination site, we do not exercise authority over these linked sites or integrated services.  Each third party website maintains independent privacy and data collection policies and procedures. We do not assume responsibility or liability for these independent methods or actions and are not responsible for the independent policies or procedures of destination sites. Similarly, we cannot take responsibility for the privacy initiatives or the content of such web sites. These links to third party web sites are provided only for your convenience, and as such, the you access them at their own risk. However, we wishes to ensure the integrity of the Site and its destination links, so any comments pertaining to the Site or any third party websites accessed through these links are greatly appreciated.

9. Exclusions

This Privacy Policy does not apply to any Personal Data collected by the Company other than Personal Data collected through the Site. This Privacy Policy shall not apply to any Unsolicited Information and User Generated Content you provide to us through this Site or through any other means. This includes, but is not limited to, information posted or requested to be posted to any public areas of the Site. Except as otherwise provided in the Terms and Use, all Unsolicited Information and User Generated Content shall be deemed to be non-confidential and we shall be free to reproduce, use, disclose, and distribute such Unsolicited Information and User Generated Content to others without limitation or attribution.

10. Changes

We may amend this Privacy Policy from time to time and will provide notice to you. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used/collected. Since we may make changes in the way we use Personal Data, you will be notified of such proposed uses, and if appropriate, you will have an opportunity to opt out of such use.

11. Complaints

We consider the privacy of its users of utmost importance, and welcome any feedback from you regarding privacy concerns. In the event of any issues or complaints regarding our alleged violation of this Privacy Policy, you may contact us at [email protected] We will use all reasonable efforts to resolve your complaints in this regard.

In the event that we and you are unable to reach a mutually amicable solution, any disputes, claims or controversies arising out of or relating to this Privacy Policy or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved individually, without resort to class action, through binding arbitration in Los Angeles, California, USA (or the city of user’s permanent US residence) before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures pursuant to JAMS’ Streamlined Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction or otherwise preclude any user from seeking individual remedies in small claims court for claims if within the scope of such court’s jurisdiction. If you initiates an arbitration under this Section 10, you shall only be required to pay an arbitrator’s fee of $250 as provided in JAM’s consumer complaint policies. Each of the parties will pay their respective attorneys’ fees associated with the arbitration and in no event shall the arbitrator be entitled to award attorneys’ fees. The arbitrator’s award will be limited to your actual and direct proven damages and in no event shall the arbitrator be permitted to award punitive, indirect, consequential, special, statutory damages. The arbitrator’s award shall be subject to the disclosure requirements set forth in the US-EU Safe Harbor Framework.
